Terms of Use

These terms are an agreement between you and Muaviyath Nizar, the individual developer who runs Camera Desk (“we”, “us”). They apply to the Camera Desk app for iPhone and iPad and to camdesk.app. By creating an account or using Camera Desk, you agree to them. If you got the app from the App Store, Apple's Licensed Application End User License Agreement also applies. Our Privacy Policy explains how we handle information.

1. Who can use Camera Desk

You must be 18 or over, and able to enter into a contract, to create a photographer account. Keep your password safe. You are responsible for everything done with your account.

2. What Camera Desk is

Camera Desk is a tool for photographers: an app to run the business, a public booking page, pages where clients follow their booking, and ways to send documents and deliver photos. We are not a party to any agreement between a photographer and a client.

Payment for a photography session goes directly from the client to the photographer. We do not handle, hold or check those payments, or the payment details a photographer shows. Clients should confirm payment details with their photographer before paying.

3. What photographers are responsible for

  • Keeping your booking page accurate, including your prices, availability and payment details. Payment details must be your own.
  • Your agreements with clients, your prices, invoices and taxes, and delivering what you promise.
  • Having a lawful reason to collect and use your clients' information, using it only to serve them, and telling them how you use it.
  • Having the rights to everything you upload, including permission from the people in your photos where the law requires it.
  • Checking documents before you send them. Camera Desk's documents, agreement templates and calculations are tools, not legal, tax or accounting advice.

4. What you must not do

  • Publish false, misleading or fraudulent content, including a business that does not exist or payment details that are not yours.
  • Pretend to be another person, another business, or Camera Desk.
  • Upload anything illegal, sexually explicit, hateful, harassing or violent, or anything that sexualises minors in any way.
  • Upload anything that infringes someone else's copyright, trademark, privacy or other rights.
  • Send spam or unwanted messages through Camera Desk, or use its email features for anyone other than your real clients.
  • Upload malicious software, or probe, scrape, overload or try to get around the security or the limits of Camera Desk.
  • Use Camera Desk for anything illegal.

5. Reporting a problem

If a booking page or anything on Camera Desk breaks these terms, or you think it is a scam, email support@camdesk.app with the page address and what is wrong. We review reports and may remove content or suspend accounts. Copyright owners can send a notice to the same address, identifying the work and where it appears.

6. Your content

You keep ownership of everything you upload. You give us permission to store, copy, show and send it only as needed to run Camera Desk for you: for example, to show your booking page, send your documents to your clients and deliver your galleries. This permission ends when you delete the content or your account, or when a gallery is deleted because a plan ended (section 7), except for backup copies, which are deleted within 90 days.

Photos in galleries. Camera Desk never owns the photos in a gallery. They belong to the photographer, or to the client where the photographer has agreed that with them, for example in their contract. A gallery can be opened only by the photographer and by the client through their private booking link, and by anyone the client chooses to share that link with. We will never open or view gallery photos, and we use them for nothing except storing and delivering them. To fix problems, we may check the technical records around a gallery, never the photos themselves. We may switch off or remove a gallery reported to hold illegal content without opening it. The only exception is a legal order requiring us to hand files to the authorities; where the law allows, we will tell the photographer first.

Your clients' information. When Camera Desk stores and handles information about your clients, we do it on your behalf and only to run Camera Desk for you as these terms describe. For that information, we:

  • use it only to provide Camera Desk to you, and for nothing of our own;
  • keep it confidential and protect it with the security measures described in our Privacy Policy;
  • use only the kinds of service providers listed in section 8 of the Privacy Policy, choose providers that protect it to the same standard, and tell you before we add or replace one, so you can object;
  • help you answer your clients' requests to see, correct or delete their information;
  • tell you without undue delay if we learn of a breach that affects it;
  • delete it when you delete it or your account, and delete client galleries when a plan ends as section 7 describes (you can download them first), except for backup copies, which are deleted within 90 days;
  • give you the information you need to show that these promises are kept.

7. Plans and subscriptions

  • Camera Desk is free to download. Without a plan, some features are limited, such as the number of bookings. The app shows what each plan includes and costs before you subscribe.
  • Plans are auto-renewing subscriptions sold through the App Store. Payment is charged to your Apple Account. A plan renews automatically at the same price and for the same period unless you cancel it at least 24 hours before the current period ends.
  • Manage or cancel a plan in your Apple Account settings. Deleting the app or your Camera Desk account does not cancel it.
  • Apple handles refunds, under Apple's policies.
  • If your plan ends, your client galleries stay open for at least 30 days after the end of your last paid period, including any billing grace period Apple gives you; after a refund, the 30 days count from the refund. Nothing is deleted while Apple is still trying to collect a payment, and you always get at least 14 days' notice. During that time you can download your own copy of every gallery from the app or your dashboard, free of charge. After that the galleries are deleted, without being opened, and cannot be recovered. We send the notices to the email address you sign in with and show them in the app and on your dashboard; your clients see the closing date on their booking page, and each client with an email address gets one email about it 14 days before. Everything else you have stored stays, but you cannot add more than the free limits allow.

8. Suspending and ending an account

You can stop using Camera Desk and delete your account at any time. We may remove content, or suspend or close an account, if it breaks these terms, puts clients or other people at risk, or if the law requires it. Where it is reasonable to do so, we will tell you why. Client galleries are also deleted when a plan ends, as section 7 describes.

9. Availability

We work to keep Camera Desk running well, but it is provided as it is. We do not promise that it will always be available or free of errors, and features may change. Keep your own copies of anything important.

10. Liability

As far as the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, or for anything that happens between a photographer and a client, including payments. Our total liability for any claim is limited to what you paid for Camera Desk in the 12 months before the claim. Nothing in these terms limits any liability that the law does not allow to be limited, or takes away your rights as a consumer where you live.

11. Changes to these terms

We may update these terms. When we do, we will change the date at the top, and for a significant change we will tell photographers in the app or by email. Using Camera Desk after a change means you accept the new terms.

12. Law

These terms are governed by the laws of the Republic of Maldives. If you are a consumer, you also keep the protections of the law where you live.
